1. Acceptance of Terms

By creating an account or using AisleRush, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and AisleRush.

AisleRush is available for users of all ages. If you are under 18 years old, you must have your parent or guardian's permission to use the app and agree to these Terms on your behalf.

2. Description of Service

AisleRush is a mobile application designed to help users create, organize, and optimize shopping lists based on store layouts. The app learns aisle locations and provides route optimization to make grocery shopping faster and more efficient.

Free Features

The basic version of AisleRush includes:

• Shopping list creation and management
• Basic store layout learning
• Item organization by aisle
• Access to one active store profile

Premium Features (Subscription Required)

Premium subscribers receive additional features including:

• Unlimited store profiles
• Advanced route optimization
• List sharing and collaboration
• Priority customer support
• Early access to new features

3. Subscriptions and Payments

Subscription Terms

AisleRush Premium is available as a subscription service with monthly or annual billing options. By purchasing a subscription, you agree to the following:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal through your Apple App Store or Google Play Store account settings
• Cancellation takes effect at the end of the current billing period

Pricing Changes

We reserve the right to change subscription pricing at any time. Price changes will be communicated to you in advance and will take effect at the start of your next billing cycle. Continued use of the subscription after a price change constitutes acceptance of the new price.

Payment Processing

All payments are processed through the Apple App Store or Google Play Store. We do not directly process or store your payment information. Refunds are subject to the refund policies of Apple and Google.

Refund Policy

Refund requests should be directed to Apple or Google according to their respective policies. Generally, refunds are not provided for partial subscription periods, but exceptions may be made at our discretion.

4. User Accounts and Security

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring that your account information is accurate and up to date

Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the service or harm other users
• Attempt to reverse engineer, hack, or compromise the app

You may delete your account at any time through the app settings. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.

5. Data Ownership and Usage

By using AisleRush, you grant us a limited license to:

• Store and process your data to provide the service
• Use anonymized, aggregated data to improve the app and create store layout databases
• Back up your data to ensure service reliability

This license terminates when you delete your data or account. We do not sell or share your personal shopping data with third parties for marketing purposes.

6. Acceptable Use Policy

You agree not to:

• Use the app for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction (including copyright laws)
• Upload or transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the app's functionality or servers
• Scrape, harvest, or collect data from the app using automated tools
• Impersonate another person or entity
• Use the app to spam or harass other users
• Reverse engineer, decompile, or disassemble the app

Violation of this Acceptable Use Policy may result in immediate account termination.

7. Disclaimer of Warranties

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy, completeness, or reliability of store layout data
• Uninterrupted, timely, secure, or error-free operation
• Freedom from bugs, viruses, or other harmful components

No Shopping Guarantees

While AisleRush aims to optimize your shopping experience, we do not guarantee:

• Accuracy of aisle locations (stores may reorganize layouts)
• Availability of items on your list
• Time savings for every shopping trip
• Compatibility with all stores or shopping environments

Store layouts change, items move, and conditions vary. Use the app as a helpful tool, but always verify aisle locations and product availability in-store.

8. Limitation of Liability

To the maximum extent permitted by law, AisleRush and its officers, directors, employees, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage arising from app use
• Damages resulting from unauthorized access to your account or data
• Damages from errors, bugs, or interruptions in service

Our total liability to you for any claims arising from these Terms or use of the app shall not exceed the amount you paid to AisleRush in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless AisleRush and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the app
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

10. Intellectual Property

Our Rights

The AisleRush app, including its design, features, functionality, trademarks, logos, and content, is owned by AisleRush and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the app
• Distribute, sell, or transfer the app or any portion thereof
• Remove or alter any copyright, trademark, or proprietary notices

Your Rights

We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.

11. Third-Party Services and Links

AisleRush may contain links to third-party websites, services, or content. We do not endorse, control, or assume responsibility for any third-party services. Your use of third-party services is at your own risk and subject to their terms and policies.

We integrate with app store payment systems (Apple and Google) and cloud services. Your use of these services is subject to their respective terms and privacy policies.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• We will notify you through the app or via email for material changes
• Your continued use of the app after changes take effect constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you must stop using the app and may delete your account.

13. Termination

These Terms remain in effect until terminated by either you or AisleRush.

Termination by You

You may terminate these Terms at any time by deleting your account and uninstalling the app. Subscription fees already paid are non-refundable except as required by law or app store policies.

Termination by Us

We may terminate or suspend your access immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Non-payment of subscription fees
• Fraudulent, illegal, or harmful conduct
• Request by law enforcement or government authorities

Upon termination, your right to use the app ceases immediately, and your data may be deleted in accordance with our data retention policies.

14. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

If you have a dispute with AisleRush, please contact us first at jani.gorse@gmail.com to seek an informal resolution. Most disputes can be resolved quickly and amicably.

If informal resolution is unsuccessful, any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in [Your State/Jurisdiction], and you consent to the jurisdiction of such courts.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration.

15. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AisleRush regarding use of the app and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, or internet service failures.
